Question by nicholashcanale: Does it make a difference to my insurance company if my record has DUI vs DWAI?
Got a DUI+DWI last Summer. DUI was dropped, DWI was reduced to DWAI. My insurance company says my MVR report has DUI on it but I had a plea agreement of a DWAI.

I am going through the steps now to have the court send a disposition to DMV so my record gets updated.

My question is, will it make a difference how much my insurance goes up if I have a DUI vs a DWAI on my MVR report?

Any advice/help is greatly appreciated and thanks in advance. Best answer lands the 10!

Yes. It should with your currnet insurance carrier. The DWI is a misdemeanor criminal offense. The DWAI is a traffic violation.

They both could land you in a very high priced insurance market if your currnet insurance company decides to non-renew your policy for either one.

Call a lawyer, become more responsible? Be glad you did not kill anyone? Sorry, I do not have much sympathy for people who get a DUI. I am SURE it is not your fault though.

I know this is kind of long but if you could please spare some of your time and read it it would really help. I’m 16 years old and the oldest of 4. Our parents are just starting the divorce process. My dad has given her plenty of chances in the past to agree to something that will keep her on his health insurance plan, but she won’t agree to his terms. My mom is irresponsible (she got a DUI when she totalled our car last year with me in the passenger seat) and immature most of the time, she always tries to tell me and my siblings stories about our dad when he’s not around and tries to turn us against him. Needless to say, I favor my dad over her.

She (and this is confirmed by doctors) has the beginnings of ovarian cancer. If she doesn’t get it taken care of, it will turn into ovarian cancer. She has a crappy job and no insurance so if she gets sick she won’t be able to get treatment unless she somehow stays on my dads plan. She told me to try and get him to agree to her terms, which I’m sure include more than just health insurance. I don’t want her to get custody of us or for my dad to have to pay her more than is necessary, but I don’t want her to get sick either. She says he won’t listen to her, and it’s true that he always takes my opinions into consideration, though I’m not sure that extends to something of this magnitude even if I did try and help her. Any advice or tips? Please don’t say “let her get sick”. I know she’s made mistakes, but my youngest brother is only 8 and I don’t want him growing up without a mom.

You need to let them come to an agreement. This should not be your job and you should not be put in the middle. As hard as it will be- let them come to an agreement. Your Mom shouldn’t be using you to get your Father to agree with her. They are grown ups and it’s their problem. I hope things work out for you and your family!

well o got a DUI in Oct 12 of 2012
im paying my fines and everything on time…
but my DUI classes i didn’t sign up on time
igot to show completion of the classes on APR 04 2014
but when i tried to sign up they said no beacuase i had passes my start date
and the only reason that happened was because i didn’t have the money at the time.
now i do but they said to re-see the judge an im scared because i don’t want him to violate my probation for that but iam paying everything else no new charges just that little problem so can you guys help me an see what am looking at ??? etc … California .. my start date was apr 4 2013 … im late !

You need to contact the court ASAP. Let them know the situation, and they will set up a court date. Make your appearance, and bring some proof that you had no money, like bank statements. Also bring proof that you had other bills, and tell him that you’ve been paying your fines on time as well. The best way to contact the court would be to send a neat formal typed letter. You can find guidelines on the correct format on Google, or www.ehow.com. Putting forth the effort to show you ran into financial issues will go a long way. If you feel that it’s necessary, you could always seek the advice of a public defender. I wish you the best of luck.

Question by aqua reef: Marine Corps, Army, Navy, or Air Force? rumors…advice?
i want to join the marines but, i heard a rumor that the marines are full right now and you could end up waiting almost a year to go to boot camp. this is a problem for me simply because i have a baby on the way and a future wife to support. i am not proud of my careless decisions, but there it is. fortunate for me and her, our parents are supportive. but i would like to support my family and i can’t wait that long. i want to go leave for boot as soon as i graduate(june 5th). i love the marine mentally, traditions, and how much respect they have, but to long of wait. So that leaves me with the army, air force, and navy. i like the sound of being a Corpsman because i could get embedded with a marine unit and still somewhat be doing what i want. but another rumor i heard, you have to be lucky to get into FMF… so that leaves me with army… and air force i suppose

any advice? are the rumors true? thank you for your time

Question by : Advice on taking care of a criminal bench warrant?
I was arrested in June of 2008 for my first DUI offense. I ended up moving to Reno shortly thereafter but I let the courts know I was leaving Vegas and moving to Reno, NV. I was scheduled to appear in court in May 2009 with a completed drug / alcohol evaluation, which I did. I was sentenced to level II DUI school (26 weeks), 30 AA meetings, a victim impact panel, a $ 600 fine, and 9 hours of Drug / Alcohol education. I was due back in court in January 2010, this year. I didn’t quite take it seriously and stopped worrying about it. Needless to say, all I had when I showed back up (yes I still went back even without completing everything) was $ 500 to pay towards my fines. I didn’t do anything else. The judge told me I had til July of this year, an extra 6 months, to take care of my stuff, or else.

Here’s where the situation gets sticky. February of this year after I came back to Reno, I ended up catching my second DUI 2nd offense Marijuana. Yes, I am a complete idiot. I admit it. Now, the problem is that they put me on a court compliance program for my second DUI and I’ve been to jail twice over it already, once on a bench warrant for FTA and once again for violating the terms of my probation. I was unable to leave Reno to go to court in Vegas in July because of the program I was in. Essentially for my second DUI I was sentenced to 52 weeks of classes and a victim impact panel (fines and court fees paid with time served in jail). I now have a bench warrant for FTA in Vegas when I was unable to leave Reno based on the terms of my program. They never extradited me back to Vegas when I was arrested any of the times in Reno for my second DUI. I assume that Reno would not let Vegas come get me because the city of Reno wants me to take care of my business up here first.

Now, I’m finally taking this seriously. I’m 21 now and I’m not going to get any younger. I simply want my name out of the system by completing both my Vegas court stuff as well as my Reno stuff. I’ve already began my classes for Reno and I won’t be done until November of next year. I’ve done my victim impact panel. I even done my Victim Impact Panel for Vegas as well.

So what should I do? I have my Reno program under control, I check in with the courts and go to class weekly, so slowly but surely I am taking care of it. My question is in regards to Vegas, my first DUI. I have a bench warrant out there because I was unable to leave Reno. I also haven’t completed any of my program for Reno except the AA meetings, the V.I.P., and paid off most of the fine. What exactly should I do? Is there a way I would be able to get it transferred from Vegas to Reno so that I can take care of it up here? It is from the same state just different counties. Should I ask my Reno judge to write a letter recommending that my bench warrant and contempt of court in Vegas be quashed because I was unable to balance both programs at once? I have my Reno business under control, I just would like advice on what to do for Vegas.

Any advice would be greatly appreciated, I am just simply trying to take care of all of this. I want to go back to school and having these cases still opened prevents that.

P.S.: I’ve quit drinking, I’ve quit smoking pot, I don’t even smoke cigarettes anymore, I’m asking for advice regarding my court predicament, NOT advice about my past lifestyle. I don’t live like that anymore and I am here right now trying to take responsibility for my actions and take care of this.

You need to at least consult with a lawyer to find out how much trouble you are still in . Most lawyers will give you an initial free consultation and then offer to take you on a retainer .

Ok my brother just turned himself in for two dui`s and two domestic violence cases his bond for the two domestic cases are $ 2,000 each minus 10% and for his two dui`s $ 10,000 minus 10% how much time could he posibably get?

I am scheduled to begin school in January 2011 for sonography, but was told by a friend who is a nurse that I won’t be hired in a medical field with a dui on my record. I don’t want to go to the time and expense of going to school if I can’t get a job.

My bf got news he was being deployed back in March. In April he got a DUI. In May he was told he was a ‘no-go’….3 months had gone by and after every monthly drill he was told, and it was confirmed he was still a ‘no-go’. They had advised him to stay behind this time to take care of his pending DUI, and when they are doing deployment sometime next year he should volunteer. He agreed to do so and I went on to fax over all of his legal papers to his first seargent. He was moved to another unit of people who were not going to Iraq this summer and they also held him back from going to his annual yearly training. After 3 months of relief and starting to move forward with our lives, we were under the impression he was clear of being deployed and can carefully take care of the DUI and finances. Come this past Monday morning his first seargent called him threatening him with signing AWOL papers and issuing a warrant for his arrest if he did not show up at his unit to be sent to NJ for deployment. After all of this time, we were not prepared AT ALL. He was in th process of straightening things out with the DUI, ARD and a finalized divorce, child support, loans, new car, etc. NOTHING was in order and now he, i and my entire family is in disarray. He has been gone for 5 days now and even told me when they were calling soldiers names off the roster to leave for training, his name was not on the list. He’s not even on their roster….something has got to be wrong…someone must have dropped the ball?…what can we do….he is not mentally or physically prepared for this and everyone is losing it. Any advice….he only has 30 days left in the states to get things in order…..i am so LOST as to how to help….im concerned for his mental well being….please help!

Question by me: What DUI attorney should be chosen?
Hello ladies and gentlemen. I was charged with 1st dui 2 days ago with BAC .21. I do remember everything and I was acting normal. I have consulted a few attorneys and will see 2 more tomorrow. Here is what I have so far. The first lawyer have been practicing for 17 years and says that he actually knows the officer who arrested me this night. I know that it is not that important, because state will still be pressing charges, but it still looks appealing. He handled hundreds of cases(IDK how many were won). That lawyer was chief of the State’s DUI Prosecution.He asks 2k for his service with a payment plan, which suits me because I am short on cash. And the only things I could find about him is 6-7 5* reviews.
Another attorney I spoke too has been practicing(almost all criminal charges) for 30 years and is a former student of my professor, whose references would lower my fees from again 2k to 1.2k.
The attorney which has a decent checkable recordcharges 4.5k, but I just can’t afford it. So, pass.
To sum it up, due to the high BAC, some may advice not hire one, because the case is in deep hole, but I still will.
Finally, I don’t leave much hope for tomorrows appointments, because they are quite the same as first two.
That is the story. Any advice on which lawyer to hire will be helpfull. Thank you.
