Well I know it was a stupid move but I got a DUI right before I graduated University and right after that I moved to China to be a teacher and researcher. At the time of my DUI I wasn’t working, had NO money, never in trouble a day of my life and just released from 8 years in the Army…I just didn’t know what to do and when I got offered a job in China I took it. I went to the initial hearing and classes but never paid the fine because I was broke. I couldn’t go to my family for help because I just couldn’t face disappointing them…I was the only one to graduate university or do anything with my life but there really isn’t a big job market for an Anthropologist with a background in Asian studies in the US.

Now after 6 years I have to go back to the US to update my Chinese visa and will have to take my 1 yr old daughter with me. My hubby is Chinese and doesn’t have a visa yet so he can’t come with us and he’s working so I have to take her with me. I can’t afford to be arrested if I have her with me…not to mention my work is paying for my trip and I can only be gone for a week.

Can I get in and not be arrested? Or should I just stay here and find another way. I would love to go home…I miss my family and they never met my daughter or husband yet. Any suggestions would be great…any help would be even more so.
FYI I no longer drink…since then. I am completely different and other then this I still have not been in trouble. I am still very naive about this stuff and they never offered me any kind of legal counsel.

Best advice in this scenario would be to have a family member here in the States contact the Clerk of Courts that has jurisdiction on this charge. The problem here is that since you didn’t pay the fine, a warrant of arrest is sitting and waiting for you, which will be checked when you go through customs.

Bite the bullet, tell a family member what happened and see if they can find out who to pay and if by paying now, will this remove the warrant of arrest. (Some states only want the money, some want a person to stand in front of the Judge). Try to resolve this BEFORE returning to the USA.
