Question by : Advice on taking care of a criminal bench warrant?
I was arrested in June of 2008 for my first DUI offense. I ended up moving to Reno shortly thereafter but I let the courts know I was leaving Vegas and moving to Reno, NV. I was scheduled to appear in court in May 2009 with a completed drug / alcohol evaluation, which I did. I was sentenced to level II DUI school (26 weeks), 30 AA meetings, a victim impact panel, a $ 600 fine, and 9 hours of Drug / Alcohol education. I was due back in court in January 2010, this year. I didn’t quite take it seriously and stopped worrying about it. Needless to say, all I had when I showed back up (yes I still went back even without completing everything) was $ 500 to pay towards my fines. I didn’t do anything else. The judge told me I had til July of this year, an extra 6 months, to take care of my stuff, or else.

Here’s where the situation gets sticky. February of this year after I came back to Reno, I ended up catching my second DUI 2nd offense Marijuana. Yes, I am a complete idiot. I admit it. Now, the problem is that they put me on a court compliance program for my second DUI and I’ve been to jail twice over it already, once on a bench warrant for FTA and once again for violating the terms of my probation. I was unable to leave Reno to go to court in Vegas in July because of the program I was in. Essentially for my second DUI I was sentenced to 52 weeks of classes and a victim impact panel (fines and court fees paid with time served in jail). I now have a bench warrant for FTA in Vegas when I was unable to leave Reno based on the terms of my program. They never extradited me back to Vegas when I was arrested any of the times in Reno for my second DUI. I assume that Reno would not let Vegas come get me because the city of Reno wants me to take care of my business up here first.

Now, I’m finally taking this seriously. I’m 21 now and I’m not going to get any younger. I simply want my name out of the system by completing both my Vegas court stuff as well as my Reno stuff. I’ve already began my classes for Reno and I won’t be done until November of next year. I’ve done my victim impact panel. I even done my Victim Impact Panel for Vegas as well.

So what should I do? I have my Reno program under control, I check in with the courts and go to class weekly, so slowly but surely I am taking care of it. My question is in regards to Vegas, my first DUI. I have a bench warrant out there because I was unable to leave Reno. I also haven’t completed any of my program for Reno except the AA meetings, the V.I.P., and paid off most of the fine. What exactly should I do? Is there a way I would be able to get it transferred from Vegas to Reno so that I can take care of it up here? It is from the same state just different counties. Should I ask my Reno judge to write a letter recommending that my bench warrant and contempt of court in Vegas be quashed because I was unable to balance both programs at once? I have my Reno business under control, I just would like advice on what to do for Vegas.

Any advice would be greatly appreciated, I am just simply trying to take care of all of this. I want to go back to school and having these cases still opened prevents that.

P.S.: I’ve quit drinking, I’ve quit smoking pot, I don’t even smoke cigarettes anymore, I’m asking for advice regarding my court predicament, NOT advice about my past lifestyle. I don’t live like that anymore and I am here right now trying to take responsibility for my actions and take care of this.

You need to at least consult with a lawyer to find out how much trouble you are still in . Most lawyers will give you an initial free consultation and then offer to take you on a retainer .

Question by Freddy: Relationship advice. Stay or go?
I want advice and opinions on this. Ok.. I am with someone who has a 4 year old. The dad just shows up or calls demanding to see the kid when he wants or when its convenient for him. If she tries to tell him no he keeps calling over and over, starts making threats, and/or has his mother call. Or he just shows up. There’s no structure, no court orders in place for when/where how long etc. he should be seeing the child. He doesn’t pay child support and never has. He is in and out of jail, has a lengthy criminal record. He was supposed to pick the kid up one time last year and he was intoxicated. The kid didn’t go with him, and on his way home he crashed his car into an oncoming car. He since has gotten the 4th DUI within 3 months of the 3rd, and she still lets him come to pick this child up with a revoked license. Being concerned for a childs safety, and even though my opinion really means squat I guess, I told her I think its really dumb to allow this to go on. The dude is married to someone else, yet she still caters to him and allows him to play games when it comes to the kid. Should I say the hell with the relationship? What are your opinions out there? Anyone want more details let me know.

Question by Angie: desperate depressed mother of a 20 year old can you give some advice?
I need some quick feedback from some parents of 20 year olds please
First off yes I may have spoiled him and I get I am responsible for that so please no lectures on that.
Since my son is going to school as well as works it is hard for him to make ends meet. So at this point I pay for his car, insurance and phone every month, now 3 weeks ago he got in major trouble and got pulled over for DUI. We talked about it and he wants to handle it alone (financially) I will let him since he needs to learn that this will have consequences and could have been a tragic ending.
Now I asked him simply to keep me posted on what is going on with that since we do not live in the same state. So for 3 weeks I have asked and waited for a call. Text or email from him, NOTHING…
Last night I had enough and suspended his phone, and today I get an email saying “ for some reason you suspended my phone, I need it for work……..”
Really “for some reason”?
I do not mind paying for things but I feel as if he hates me and that is so depressing. How do you other parents cope ? I want to do the right thing but the right thing also involves respecting me , please pass me on some advice. Is this a phase at this age? Am I over reacting?
Maybe he just does not love me and he wants me out of his life, i cannot stop crying I am so sad

Hi there! So I am a 19 year old. My mom is a single mother of 5 kids. My older brother is 20 going on 21. My mom has had her fair share of trouble with my 20 year old brother, so much that we’ve had to kick him out of our lives. Even though this seemed harsh and like we were throwing him under the bus, it really wasn’t. He was giving us absolute, grief and misery. So it was only right that we’ve had to do that for the sake of our own lives and health. From my perspective, I can tell you that I truly depend on my mom. She literally has to do everything for me, since we are in a poor financial situation. She supports (now the 4 kids) feeds us, pays for bills, and gives us rides to school every single day. So yes I depend greatly on her. If she were to ever leave me (which I doubt she would) I know I’d be stuck and I’d have to seriously find my way around quickly to support myself. Since your son lives in a different state than you I’d imagine it’s easier since whoever he lives with ( a room mate or by himself) he definitely can support himself. I cannot get a job to help my mom with the rent because of some weird thing about getting my college tuition getting cut off, or child support getting cut also. My dad doesn’t pay jack $ hit to any of us. But yeah I’d suggest encouraging your son to get his own job and then reassuring you that he is doing fine. If he needs your help, ask him first if he can try and solve it himself but if not slowly help him out. Good luck! I hope this advice helped you a little lol

Question by : I want to take my ex to court for full custody.need advice….?
My ex and I have a soon to be 4 year old son. I have been dating someone else now for two years and he takes care of my 3 year old as if it were his own. My 3 year old often call my current bf daddy. My ex never calls to check on his son. He will go weeks without calling. I can’t imagine going hours without checking in on my kids. He speaks of wanting to see him but actions speak louder than words. He is an alcoholic and is possibly going to jail in June for getting his 3rd DUI. He owes his son $ 3000+ in child support. He is pretty much just worthless to me and his son and I just want some advice on taking him to court for sole custody. Like, I don’t want him to pay me child support anymore either. I just want him to leave us alone. He breaks plans with his son all the time and i’m the one that has to explain to him that he isn’t going to see his dad. My new boyfriend and i are talking about moving to another state and I just want to get custody of my 3 year old. Everyone i have spoken to has said they will vouch for me in court that i’m the one doing everything for my son and that i pay for everything (i get like $ 50 a month in child support even though i’m ordered to get $ 455). Please help.
we were never married thank god! he just does nothing and expects everyone to be there to bail him out of jail and feel sorry for him. im just over it.

i need help writing my job application/ interview…

i held a job through a temp agency for 6 months with a company…until recently i was let go. The story is: i got arrested on cinco de mayo at a check point for driving with a suspended license. No dui, speeding, wreckless driving…i was pulled to the side because my brake light had gone out. My car was towed and i was detained for 48 hours. Because i couldn’t call out, my job let me go due to, what they say problems with dependability…ouch.
For my next job, i’m thinking of not putting down the prior job afraid they’ll say i wasn’t dependable and missed days.
But the gap in between the work period is suspicious. What have you done in the past that has helped you with this situation…or any advice is welcome.

List the missed work, every employee misses work because of illness, etc. It the absences were excessive, that is a different story.

Question by Jennifer: Driving and not remembering… I really need advice?
I take pain pills and muscle relaxers that are prescribed to me from my doctor for back pain. I also take Lexapro for depression. I wait hours before I drive to make sure it wears off because it causes confusion and dizziness in people. Where I’m getting to is… with my particular depression, I tend to dissociate. I don’t remember things, it’s like an unconscious thing… almost like daydreaming. This has happened to me twice while driving, and I’ve ended up in a completely different place. I don’t know if it is going to happen to me or not until I’m already behind the wheel. I have to drive. It’s not an option. But I’m scared to death that I’m going to get pulled over and not know my basic information, or what I’m doing there. I’m also worried that if a cop does try to stop me, I won’t even notice him. It’s confusing… and I’m worried that I could get a DUI or something for being on prescription medications that cause side effects like confusion and dizziness, even though I know that this isn’t the reason I’m dissociating.

What would you do in this situation? Any advice?
Like I said, the drugs aren’t what is causing this… and I wait HOURS before I drive after I take the drugs.
I’m not driving dizzy and confused, those are some side effects to the medications I’m taking. I wait many hours before driving to make sure the medicine wears off.

I’m driving without remembering period. I don’t remember a thing.

Cut back on the drugs or stop driving. You are a danger to society driving on drugs. You would get a DUI.

Question by Lillie: court for a “violated probation” tmw. any advice? any idea outcome?
almost 2 years ago i received a dui in colorado. i acknowledge it was stupid and a horrible decision. if i could take it back i would. i am 20, almost 21 now. i was sentenced to 1 year probation, 24 hrs community service and 12 dui classes. last may when i finally got a probation officer, i told her that i couldn’t afford the dui classes because they were $ 25 each class, weekly. i did, however, do double my community service hours and attended every probation meeting i had set up monthly. i now have a court date tomorrow morning in regards to not being able to start my dui classes on time. (i now have over half of them done–) what’s going to happen to me since, by not being able to go to my classes, i “violated” probation?? any advice on what i can say because i don’t have a lawyer?

You need a lawyer.

Go to court and see the Public Defender ( free).

This depends entirely on the Judge.

Your situation does not sound terribe like someone who commits a DUI while on probation.

Having done extra community service, you may get a break.

Me and my guy broke Up two weeks ago. During our relationship he got a DUI it was a very hard situation in the beginning. When it happened he was a mess. He thought he was going to lose his job etc because of this situation. I’m sure if you or have been in this situation you would think the same. Anyway, so during our relationship, I drove him everywhere because he obviously can’t drive. I pretty much helped him a lot I’d take him to his DUI classes every Thursday, every morning I would take him to the subway so he could get to work and pick him up from the subway to take him home, if he needed to go somewhere I’d pick him up and take him. When we broke up there was some arguing I think because of frustration? We didn’t have any major problems, he told me he wants to find himself and grow. I guess I helped him so much that he didn’t realize how hard it really is. He told me that he needs to grow and better himself before we move any forward. I personally think it’s true. I feel positive about this whole thing. He even told me himself ” I cant be with you right now because I feel useless, I can’t drive and we can’t do things like we use to” I’m trying to put myself in his shoes and picture if I had a DUI, I’d be feeling like crap too! I love this guy so much, I understand where he’s coming from,I want the best for him. We had a talk and I told him That I love him very much and I’m still here for him no matter what just like I promised, if he ever needed me I’d be here. I don’t think he’s just trying to find a reason for us to break up, because we still talk and care for each other I think if he didn’t care or love me he would have gotten rid of me for good! My point is how do I keep our love alive? I don’t wanna bug him or smother him. I wanna give him his space just like he asked. I wanna be that girl who undertsands. I obviously don’t wanna call him every single day like I use to when we we’re together but I still want to show him I love him and care about him. We’ve known each other for 8years, so I really know him and I’m trying my best to understand him and give him his space. Any advice as to how I can keep us strong? What can I do during this time to show him that I still love him? Can you guys help please! :)

just show him that because he cant drive it doesn’t mean hes useless.
ask him if he wants to go somewhere? like meet him at a restaurant or cinema or something.. let him pay..trust me it makes a guy feel more manly when he pays.. show him you love him.. maybe ask him if he wants to spend the day together? get him to come over to your house and walk to the park or the mall? go shopping and get some ice cream or to the beach?
dont call him everyday but maybe call him once or twice a week? ask him how he is, what hes doing, if hes done anything exciting..
for example he goes to his DUI meetings every thursday.. so phone him tuesday and ask him how he is.. then maybe phone him on thursday ask him how the meeting went? just show him you care :)
remember to tell him how you feel.. dont just bottle it up.

ok so here it is.. my boyfriend and daughters (she is 2 weeks from being 3 yrs.old) father have been together for 5 years. just recently he was in jail for about 5 months.(nothing too serious just a dui) i did everything i possibly could for him during this time. after he got out everything was so wonderful. the best it could be. he was calling me or texting me all the time. which is great due to before it was always me doing the work. we went as far as talking about having another baby together and finally moving in together again. so about 5 days ago we got into a fight. he was calling me a liar and all sorts of mean things. he said he didn’t want to be with me anymore. i have sent him a text a day which he has choosen to ignore. i send them because i really love him with all my heart. i would do anything for this man. i am just so lost and confused right now. i miss him so much. it is just so hard to even try to think of letting him go when i love him this much! i mean this isn’t the first time we broke up or anything its happened before but the longest we went without talking is 6 months (his choice) please if anyone could help me with some advice or if you have been in this situation i would apprecieate the answers!!!

my daughter keeps saying i miss daddy and i want to see daddy. it just breaks my heart. i just tell her that daddy is busy with work and he loves you. i d on’t want to say anything negative about him to her or anything at all because i love him but he is only thinking of himself.

I really feel for your honey. With or without my advise i sincerely wish you the best of luck. In situations like this you have 3 main options. 1. Confront him ( and not over text, that’s the wost way to communicate with someone) go to his house, work, hang out spot and talk to him face to face. find out what he really wants to do, and why he is acting the way he is acting. After 5 years he owes you that explanation, so demand it. 2. Leave him alone. He expects your calls and texts, so if you just stop one day he is gonna wonder why. Leave your phone at home when you go to work if you have to. And if he doesn’t come back running then move on, you cant make someone date you or love you. If he doesn’t want this then you can still walk away with your head up high. 3. Take him to court for child support and demand that he sees his child. you can have it court ordered. Either way i hope you pick the option that is right for you. Im sure you know what it is already. I wish you the best of luck dear.

Question by eitiac: I need some legal advice on my recent arrest..?
I recently got arrested for illegal consumption and zero tolerance. I should of been charged with a DUI because I blew .179, but the officer gave me a huge break…I was wondering if anyone could over rule those charges, and turn them into a DUI? I live in La Salle county, Illinois. So if you are familiar with the laws around here or have been in a similar situation and could give me some advice that would help immensely.
