Call a lawyer, become more responsible? Be glad you did not kill anyone? Sorry, I do not have much sympathy for people who get a DUI. I am SURE it is not your fault though.

Question by me: What DUI attorney should be chosen?
Hello ladies and gentlemen. I was charged with 1st dui 2 days ago with BAC .21. I do remember everything and I was acting normal. I have consulted a few attorneys and will see 2 more tomorrow. Here is what I have so far. The first lawyer have been practicing for 17 years and says that he actually knows the officer who arrested me this night. I know that it is not that important, because state will still be pressing charges, but it still looks appealing. He handled hundreds of cases(IDK how many were won). That lawyer was chief of the State’s DUI Prosecution.He asks 2k for his service with a payment plan, which suits me because I am short on cash. And the only things I could find about him is 6-7 5* reviews.
Another attorney I spoke too has been practicing(almost all criminal charges) for 30 years and is a former student of my professor, whose references would lower my fees from again 2k to 1.2k.
The attorney which has a decent checkable recordcharges 4.5k, but I just can’t afford it. So, pass.
To sum it up, due to the high BAC, some may advice not hire one, because the case is in deep hole, but I still will.
Finally, I don’t leave much hope for tomorrows appointments, because they are quite the same as first two.
That is the story. Any advice on which lawyer to hire will be helpfull. Thank you.
p.s. I decided to stop drinking because that is the only approach to never get another charge as such. Plus, remember: “What happened 1 time may never happen again, but what happens 2nd time will most likely happen 3rd, 4th and etc.” Paolo Coelho

first off, im 17 i live in utah and last night i got a dui paraphernalia and minor consuming ticket.
im not the type of person to drive even if its just a couple beers

i remember being pulled out of a car(no idea where i was goin or how i got there or even who the 5 people in my car were at the time)
my best friend told me i left with a kid named cody(16 with a license)(also sober) and that he was driving. there were two girls(ages 16 and 18 in the car who drank nearly as much as me(my BAC = 0.24) .
two more males ages 15(ty) and 17(david) one of which was smashed the other not but had obviously been drinking..

as the story goes, i was arrested and on my way to the station because im a minor..

but.. alll 5 of the people, which 4 had clearly been drinking, were released immediately after my arrest without being searched or having parents called.
all 5 of them walked home(not together)

it was 11:42 at the time of my arrest and curfew is 12midnight

why would police let a 4 drunk minors walk home without giving any tickets or calling any parents?
and let an adult in the car with a minor walk home with even getting a public intox

another big fact is that i am african american and live in a town where i can go for days without seein another black person,, all 5 kids that were released were caucasian..

just found out today,, i was actually in the back seat of the vehicle until it was pulled over, at that time the sober individual driving, (codi) switched me seats, i have texts to prove it and also a friend (probably not a good one) told me the same story, he didnt say anything to the police because he was scared

any chance it will be dropped or lessened? another question is should i save the texts that admit to codi drinving and switching me seats at the time of the stop?

I’m 22 and I drink on special occasions. Just that one night i chose to go out alone I drank to relax and have fun. Leaving an hour gap beforeheading home, I take of and of course I got pulled over. around 12 am on the 30th, and was trying to head home from the club. five minutes of driving I get pulled over. I had about 3 drinks and a beer all in 6 hours of being there. Cop says I was serving, so I agreed to cooperate with everything. He gave me about 5 field tests which he commented about how I was doing better than most people, I stumbled because of my nerves but I;m 90 percent sure I did them all well then he decides to give me the breathalizer. After the second blow he told me “Unfortunately your level is over the legal limit and I have to place you under arrest” for a dui having a bac level of .089 . sacramento, ca downtown I st where I got pulled over, isn’t the best place to drive, due to pot wholes and of course cars parked on the side, and a busy st.which i swerved for, i was driving on a one way st the lane all the way to the right. then 5-10 minutes later we arrive to the station where he then told me to take another breathalyzer, I then blew .077, he didnt explain what was going to happen with that, but i knew for sure I was below then. The officer was really nice,didn’t tow my car and thanked me for cooperating the whole time and says he’ll put in a good comment on the document? at this point i was thinking (THEN WHY ARREST ME? ) so of course scared and nervous I just continued following direction and next thing I knew I was in the tank for 17 hours! Their system was down and couldnt finger print us? so now we’re stuck waiting because they can’t fix there system? It was quite an experience. I just need advice and help, should I get a lawyer and fight this? or will it be a waste of money. Will the public defender do much for me? Its my first offense and I’m really scared and not sure which step I should take.

firt of all you are BARELY over the limit.Thats good.I would fight it with a public defender.The reason being YOU ARE GOING TO LOSE but your lawyer can make sure you get light punishment(assumeig this is the first
time you been arrested b4)they might even work a deal where it will disappear as long as you dont get into trouble again.EVER.ever again.
THEY Are prety ight on 1st offenders.but def. GET A LAWYER

Question by SpeshL BLenD: Should I do substance abuse evaluation or counseling for DUI?
My lawyer said that since my readings were high for my DUI and I am underage, in order to get less than 12 months of loss of license I need to either have a substance abuse evaluation or show some proof of counseling. I would really like to try for 7 months instead of 12, what do you think I should do, which is easier and which will cost less? Will insurance cover either? Since I am a kid in college and the drinking habits of kids are technically alcohol problems as it is, will I most likely do bad in the evaluation? I don’t have any other psychological problems or other substance abuses, I just used to drink a lot when everyone was back for the summer.

Any advices or experiences are greatly appreciated

Question by wid3awake: How should I address my bad credit and DUI?
I’m having a crisis. It’s been over a year and a half since I had a real job, and I’m desperate. At this point I’m renting space on someone’s couch, since I’ve lost everything: car, marriage, apartment, you name it.

Before I got myself together, but during this whole downward spiral, I received a DUI. Now I don’t drink. I attend AA, do community service, pay my probation on time. When I go to a job interview, it always goes well. I know no matter how good I do face to face, when they see my paper (credit report and background check) I get the inevitable letter advising me that I haven’t been accepted. I get all the free credit reports I want now, but have no money to pay down the car repo, the court costs, the classes for DUI or MADD, the medical bills, apartment repossession, or any of the other stuff that’s adding up.

I know I could be more effective with help but I’ve been frustrated when I show up at the unemployment office and try to explain why I’m getting turned down. The help at the center doesn’t seem to be able to handle giving advice on the issue.

I created a letter of explanation, for the adverse items in my report and background. So far everyone I talk to about it is unanimous in saying not to include it as part of an application.

Looking it over I realize that giving too much information up front is going to run the employers off. And if they do have concerns I think it would be best to give extremely general and brief allusions to what happened and then get right on to focusing on how I’ve improved.

What else is there to do? Are there ‘second chance’ white collar jobs out there? Due to medical reasons, I can’t just start doing labor jobs. Programs for misdemeanor offenders, or people with horrific credit reports?

Any suggestions would be helpful. Thanks for your answers.

Well, this situation sucks. Sorry. It’s rough out there for most, and then here you are swimming upstream to boot.

You might try looking for a “job coach” or someone who had been in a similar situation like yours and who would be willing to “mentor” you back into a good position again. So that’s one idea.

Another idea is, in the next set of interviews, go into it “proactively” and tell them up front that while you’ve had difficulties in the past, that you’ve overcome all of that and are super motivated and inspired to do an amazing job for them and that actually, whoever does hire you will be very lucky because you’ve learned so much about life from all of your experiences, that you’d never take such chances again or make such horrible decisions again, either.

My advice just has to do with “disarming” them – you know, telling them up front that some things in your past may not look so great, but you’re so acutely aware of how to do things differently in the future, that you’ve learned so much from this, that you are very motivated to do an amazing job for whoever the lucky one is to hire you. And then of course, you have to stand by your word, and mean it. Make a commitment to turn your life around.

So, be honest but turn it around in a way to them, so that they can see that you have learned and grown and changed form this past. And again, mean it.

Question by Rachelle Rachelle: How should i gain my parents trust back after a dui?
I am a freshman in college, and I recently got a dui about 5 days ago. My parents are really dissapointed in me and have only contacted me through short texts and emails. I just signed a lease for an apartment near campus with three of my friends, although my paretns have not signed the gaurantor agreement yet. They are now saying they cannot trust me and have told me to sign up for dorms, even though they already know i put down a deposit and filled out the paperwork for my lease. The only way to get out of it would probably be to sublease to someone. My parents have said stuff similiar to this when they are mad and later forgiven me and changed their minds. I am hoping that this turns out the same and I will still be able to live with my friends, and I want to prove to them that nothing like this is ever going to happen again and that i will be more responsible than ever living in an apartment next year. Does anyone have and advice or suggestion that could help me?? I have started to write a letter to them to let them know I am changing for the better and understand why they are so upset with me.
I do know how horrible of a thing this was and willl never do anything like it again, and have already gotten so much support from my friends up here, several of them have agreed with me to start doing activites not involving alcohol and finding different ways than partying to meet people and have fun, and im going to continue this pattern, but i just wish my parents knew how serious i am about this whole thing and what a wakeup call it was to me

Question by Tee: What should I plead in my DUI case if I just want time to get a lawyer?
Happened in Virginia…blew 0.14…first offense.

Obviously I can’t plead “guilty” because everything would be done and over with and I wouldn’t be able to have an attorney.

I don’t feel right saying “not guilty” because I doubt I have a legit case. But at the same time, I’d have time to get an attorney if I say this.

I’ve heard that pleading “no contest” is the same as pleading guilty.

So what do I do? My arraignment is in two days and I doubt I’ll have a lawyer by then, but I think I want one (to see if the charges can be lessened, etc.)

What should I plead if I just want to buy time to get a lawyer?

Well you could have taken the dui class before your court date, it will help you A LOT. but since you said the court date is in 2 days. Then yea, you should plea no contest. It means you neither admit or denies the charges. Usually they will give you a good plea bargain versus admitting the charges and receiving the full term.

I received my first DUI conviction about two years ago (2007). It was a misdameanor. I passed all the background checks for school because one DUI is permissable. I just finished my first year of nursing school and was enjoying the summer until I got a second DUI on June 24, 2009. I have not been convicted yet, and probably will not be for at least a couple months. I am scheduled to take my NCLEX on July 21, and I am wondering if I should tell the board of nursing about the second DUI now, or wait until I am convicted… ADVICE PLEASSSSSSE!!!

I recommend that you interview several attorneys who specialize in the defense of DUI.

I recommend that you hire the attorney with the most successful experience in the defense of DUI.

You did not say what the Police said that your blood alcohol level was or how it was determined.

Most blood alcohol tests by the Police tend to be at least 50% higher than the actual blood alcohol level as determined by a reputable medical laboratory.

Unless the Police determined that your blood alcohol level was very high, it is very likely that your blood alcohol level was actually below the legal limit, even though the Police may say that your blood alcohol level was much higher.

That is why you need a very good attorney who has substantial successful experience in the defense of DUI.

Essentially your career and your livelihood is on the line here.

the Attorney fees are much less than your loss of income or the cost of changing your career.

I recommend that you start interviewing attorneys today.

Interview the attorneys as you would any job applicant. The attorneys are applying for the job of defending you against the DUI charges.

If you are represented by a good attorney with substantial successful experience in the defense of DUI your chances of an acquittal are probably very good.

If you are not represented by an attorney with substantial successful experience in the defense of DUI the chances that you will be convicted are very high.

If you are convicted, that will probably be the end of your nursing career.

I strongly recommend, hire the attorney to represent you.
